A new Category for Action Theory

How should action theory describe acts that are intelligible as breaches of a norm without being either corrigible errors or ratifiable innovations? Focusing on cases such as deliberate failure, principled refusal, and non-permitted novelty, I argue that influential accounts of agency—Anscombean, practical-knowledge, and control-based views among them—tend to privilege successful performance, correction, rational control, or uptake as markers of intelligible agency. This leaves underdescribed a distinct normative status: actions that are recognisable, criticisable, and answerable within a shared practice while remaining unauthorised by the standing norms they breach, independently of whether they are later corrected, ratified, or neither. I call this status intelligible rupture. Drawing on Wittgenstein, I treat intelligibility as public and practice-internal rather than grounded in private standards. Drawing on Lacan, I use the notion of non-closure within practice to explain how agents can be formed by roles, reasons, and demands without being exhausted by the authorised positions those norms make available. The result is a distinction between intelligibility and permission, and a correction to a success-centred picture of agency: agents are not only competent performers, rational controllers, or future innovators, but are also capable of breaches that remain intelligible as breaches in their own right, rather than deriving their normative status from correction or ratification.
